China Issues Detailed Criminal Regulations for Online Porn

China's Supreme People's Court and and Supreme People's Procuratorate have issued statutory interpretations regarding the enforcement of laws against the production, reproduction, publication, sale and distribution of pornographic electronic content via the Internet and mobile communications terminals and voice services. The interpretation classifies as a criminal offense the production, reproduction, publication, sale or distribution of 10 or more pornographic videos; 50 or more pornographic audio files; 100 or more pornographic electronic publications, photos or written documents; the operation of any membership-based network conducting said activities with 100 or more registered users; and the receipt of RMB 5,000 or more in advertising, membership or other fees for pornographic content.

Telecom or Internet service provider employees who knowingly provide Internet access, server hosting, online storage, transmission channels or other paid services to five or more pornographic websites, or provide such services for fees in excess of RMB 20,000, or receive fees in excess of RMB 50,000 for other services provided, will be charged with profiting from the distribution of pornographic content.

Those found to be providing funding to any party involved in the above crimes through either direct or indirect means such as advertising or third-party payment services will be charged as collaborators in a criminal act if found to have: provided advertising services or other forms of funding to 10 or more pornographic websites; provided 12 or more advertisements to a single pornographic website; provided payment services to 10 or more pornographic websites; provided those sites RMB 50,000 or more in funds through advertising or other methods; or provided such sites billing services for which service fees totaling over RMB 20,000 have been charged.
