China Tightens Rules on AV Content Distributed via Social Networking Platforms

China's State Administration of Press and Publication, Radio, Film and Television (SAPPRFT) recently issued new rules for audio-visual programming distributed on social networking platforms, with a particular emphasis on microblogging platform Weibo (Nasdaq: WB) and Tencent's (0700.HK) WeChat mobile messaging app. SAPPRFT did not specify when the new rules would be implemented.
The rules require that online platforms that offer audio-visual programming through social networking applications such as Weibo and WeChat must obtain an online audio-visual service provider (AVSP) license and must operate within the authorized business scope.
Organizations that already have an AVSP license and offer audio-visual programming through applications such as Weibo and WeChat should operate within the limitations required by the license terms. Organizations and individuals that have not obtained an AVSP license may still offer audio-visual programming through a Weibo or WeChat account, but the social networking service must assume responsibility for program content. Furthermore, the scope of content distributed on SNS platforms must not exceed the scope specified by the distributing platform's AVSP license. Online platforms are prohibited from providing services and other technical support for Weibo and WeChat accounts that do not conform to these terms.
Movies and television series broadcast through social networking apps such as Weibo and WeChat must be authorized under appropriate licenses for public screening and distribution.
The content of audio-visual programming such as online dramas and movies, news programs, recordings, and variety shows must be in accordance with regulations for online audio-visual content management. Online social networking applications such as Weibo and WeChat may not broadcast original political and current affairs programming uploaded by individual Internet users.
The new rules also require provincial press and publication departments to strengthen oversight of services offering audiovisual programming through platforms such as Weibo and WeChat within their jurisdiction.
