China's MIIT Issues Regulations on Customized Handsets

On April 21, China's Ministry of Industry and Information Technology (MIIT) released regulations targeted at operator-customized handsets.

According to the regulations, both the party placing the order and the manufacturer of the customized handset should have a clear agreement delineating responsibility for issues including product quality and after-sales service.

In addition, the ordering party must strengthen its oversight of the services installed on the handset. In cases where the ordering party provides its own value-added services, it must not restrict consumers from using other providers' value-added services. The customized handset may not be pre-installed with hard-coded wireless value-added service provider (SP) codes, links to SP services, or client software from SPs.

Operator-customized handsets may not be locked to a network, and should allow consumers to choose compatible network services provided by a different operator.
