Non-profit Online Sales Exempt from Registration

Yesterday the Beijing Administration for Industry and Commerce (BAIC) began soliciting the public's opinions and suggestions online in regard to the proposed new "Informatization Promotion Regulations". The "Regulations" require that e-commerce operators obtain business licenses and publicly provide business information on their home page. E-commerce operators falling into any of the following categories are exempt from registration: enterprises or individual industrial and commercial entities which already possess a business license and only operate within that business scope; e-commerce operators which already hold a permit for Internet information services operation plus a business license issued from the BAIC; and, individuals selling or exchanging personal goods online without intent to profit.

The "Regulations" also stipulate that e-commerce service providers must verify business licenses and relevant documents of those e-commerce operators with whom they sign service contracts, and establish transaction records to be preserved for a minimum of two years.
