Proview Wins Huizhou iPad Infringement Lawsuit

Xie Xianghui, attorney for Shenzhen-based display device manufacturer Proview Technology, a subsidiary of Proview International Holdings (0334.HK), has announced that Huizhou Municipal Intermediate People's Court has ruled in favor of Proview's trademark infringement lawsuit against local iPad dealers, specifically prohibiting Shenzhen-based electronics retail chain Sundan's Huizhou outlets from selling iPads.

The ruling also named Apple's mainland China distributor Apple Computer Trading (Shanghai) Co., Ltd. as a third party, which Xie said implies that iPad sales nationwide constitute copyright infringement, but the court ruled that since the plaintiff did not attribute any clear responsibility for the third party, it could not rule on Apple's liability.

According to an industry source, Proview is suing distributors in order to force Apple to come to the negotiation table.
